Course description

This discipline is an important component of the study program related to information technology and law, and aims to familiarize students with the main aspects of legal regulation in the field of information technology.

The discipline “IT Law” is designed to form students’ competence in the field of legal regulation of information technologies.

The study program provides students with the following skills and knowledge:

Understanding IT law: Students are introduced to the basic concepts, principles and concepts of IT law. They study key legislative acts and international agreements that regulate the use of information technologies.

Analysis of legal aspects of the IT sphere: Students are able to analyze legal aspects related to the use of information technologies. They address issues of privacy and data protection, copyright, cybersecurity and cybercrime in the context of today’s legal environment.

Development of ethical thinking: Students evaluate ethical issues related to the use of information technologies and understand the importance of observing ethical principles in this area. They develop skills in identifying legal risks and finding ethically sound solutions.

Distinguishing the interrelationship of IT law with other areas of law: Students understand the interrelationship of IT law with other areas of law such as civil law, criminal law and administrative law. They study the legal status of individuals in the context of technology use and understand how legal norms affect the development of information technologies.

Orientation in current trends: Students gain knowledge about current trends and developments in IT law, such as new legislation, case law and international standards. They study modern challenges related to the use of information technologies and understand their impact on society and business.

The study of the discipline “IT Law” contributes to the preparation of students for work in the field of information technologies, allows them to understand and take into account the legal aspects of decision-making and the use of technologies in accordance with current legislation.

The subject of the academic discipline is legal aspects, legal norms, and regulatory requirements related to information technologies. This subject considers the interaction between law and the field of information technologies, in particular, the legal regime of electronic documents, cyber security, personal data protection, intellectual property in the IT industry, the legal status of electronic commerce and other important aspects. The purpose of studying this subject is to understand and apply legal principles and norms for effective management and regulation of the field of information technologies.

The purpose of the educational discipline

The purpose of the educational discipline “IT law” is to acquaint students with the main legal aspects related to the field of information technologies, and to provide them with the necessary knowledge and skills.

The main goals of studying IT law are:

  1. Understanding of the legal environment: Students should have knowledge of the legal rules, regulations and regulatory requirements that apply to the field of information technology. This includes knowledge of legislation, international treaties, standards and policies that govern the use, protection and sharing of information in the IT sector.
  2. Application of legal principles: Students are given the opportunity to apply legal principles to practical situations arising in the field of information technology. They learn to analyze legal issues, identify risks and seek legal solutions to ensure compliance with the law and protect the rights and interests of the parties.
  3. Ensuring security and privacy: Students are introduced to the legal aspects of cyber security, personal data protection and information security. They study information protection requirements, the principles of personal data processing, as well as the legal consequences of a breach of security in information systems.
  4. Understanding Intellectual Property: Students are explained the legal aspects of intellectual property in the context of information technology, such as copyrights, patents, trademarks, and other forms of intellectual property protection. They learn to understand the importance of protecting intellectual property and using information within the limits of the law.

In general, the goal of the educational discipline “IT law” is to prepare students to understand and solve legal issues arising in the field of information technologies, and to provide them with the necessary knowledge for effective management and compliance with legal norms in this field.

 

Requirements for knowledge and skills

The study of the educational discipline “IT Law” involves the achievement of such a qualification level of bachelor’s training, for which he must:

  1. a) know:
  • basic principles and concepts of IT law: The student must have knowledge of the basic principles, concepts and concepts related to the legal regulation of information technologies. He should be familiar with the basic terms used in this field, such as copyright, cyber security, privacy, e-commerce and others.
  • main legal acts: the student should be familiar with the main legal acts and international agreements related to the field of IT law. He must know the important norms and principles that govern the use of information technology, such as the Copyright Law, the Law on the Protection of Personal Data, the Law on Electronic Commerce, etc.
  • understand the relationship between IT law and other branches of law: The student should have knowledge about the relationship of IT law with other branches of law such as civil law, criminal law, administrative law, etc. He must understand how IT law affects the legal status of individuals, protects their rights and regulates the use of technology in various areas of life.
  • to navigate the current trends and development of IT law: the student should be familiar with the current trends and development of IT law, including new legislative acts, judicial practice and international standards. He must be able to monitor changes in IT law and assess their impact on IT practice and business.
  1. b) be able to:
  • understand and analyze legal norms: the student must have the ability to understand complex legal texts, understand their content and analyze them in the context of information technologies. He must be able to determine the legal norms that apply to a specific situation in the IT industry.
  • apply legal principles to practical situations: the student must have the ability to use legal principles and norms to solve specific legal problems arising in the field of information technologies. He must be able to analyze the situation, apply relevant legal norms and develop action strategies taking into account legal restrictions and possible consequences.
  • assess risks and ensure legal compliance: The student must be able to identify potential legal risks associated with the use of information technology and develop mechanisms for their management and reduction. He must be able to ensure compliance of the organization’s activities with the requirements of legislation and regulatory norms.
  • use effective communication: The student must have the ability to communicate complex legal information clearly and logically, both in writing and orally. He must be able to carry out professional communication with other specialists, clients and interested parties in the field of information technology.
  • to solve ethical issues: the student should be aware of the ethical aspects of using information technologies and be able to solve ethical issues arising in the IT sphere. He must have an understanding of the importance of ethical principles, confidentiality and protection of personal data.

 

The place of the educational discipline in the structural and logical scheme

The educational discipline is interconnected with such disciplines as “Information and communication technologies”, “Digital economy”, “Internet technologies”.

Name and description of competences, the formation of which ensures the study of the discipline.

When studying the discipline “IT Law”, students of higher education acquire the following competences (ability):

ZK3 – Ability to abstract thinking, analysis and synthesis.

ZK5 − Ability to communicate in the state language both orally and in writing.

ZK8 – Ability to search, process and analyze information from various sources.

ZK9 – Ability to adapt and act in a new situation.

ZK10 – Ability to be critical and self-critical.

SK5 − Ability to use modern legal doctrines and principles in law-making and in the process of applying private law institutions in order to acquire fundamental knowledge about the legal nature of IT law institutions, the ability to distinguish the methods of legal protection of the relevant institutions.

SK6 – Ability to justify and motivate legal decisions, to give detailed legal arguments. Be able to analyze lawsuits, complaints, court decisions for compliance with the requirements of legislation in the field of information technologies. To develop the skills of preparing legal opinions and consultations regarding problematic situations related to the legal protection of the rights of information technology subjects.

SK7 – Ability to apply knowledge and understanding of the basic principles (principles) and procedures of civil, economic, and administrative proceedings in Ukraine when resolving disputes regarding the protection of rights in the field of information technologies.

SK9 − Ability to apply an interdisciplinary approach in the assessment of legal phenomena and law enforcement activities using norms of civil law, civil procedural law, economic law, economic procedural law, administrative and informational law, etc.

SK11 − Ability to critically evaluate the effectiveness of representation and protection of the rights, freedoms and interests of clients when resolving disputes related to the protection of rights in the field of information technologies. Evaluate and analyze the activities of IT companies, IT specialists, e-commerce entities, and other IT law entities.

SK15 – Ability to independently prepare drafts of law enforcement acts, taking into account the requirements for their legality, reasonableness and motivation. Master the competencies related to the preparation of draft court decisions based on the results of consideration of disputes regarding the protection of the rights and interests of a person in the event of a violation of rights in the field of information technologies.

SK14 – Ability to analyze problems and phenomena in one or more professional fields in depth, taking into account economic risks and possible socio-economic consequences.

SK17 – Ability to manage and use modern information and communication systems and technologies.

Program learning outcomes:

PR05 – Apply analytical and methodical tools for justifying proposals and making management decisions by various economic agents (individuals, households, enterprises and state authorities).

PR06 – Use professional argumentation to convey information, ideas, problems and ways to solve them to specialists and non-specialists in the field of economic activity.

PR10 – Conduct an analysis of the functioning and development of business entities, determine functional areas, calculate the relevant indicators characterizing the effectiveness of their activities.

PR13 – Identify sources and understand the methodology of determining and methods of obtaining socio-economic data, collect and analyze the necessary information, calculate economic and social indicators.

PR25 − Understand the structure, basic principles of activity and business processes of subjects of the IT industry.

 

Learning outcomes

As a result of studying the educational discipline “IT Law”, students will be able to:

  1. Understand the legal context of information technology: Students will have an in-depth knowledge of the basic principles and concepts related to the legal regulation of information technology. They will understand important terms and concepts related to IT law.
  2. Apply legislation to situations in the IT sphere: Students will be able to apply norms and principles of IT law to specific situations arising in the field of information technologies. They will know the main legislative acts and international agreements regulating the use of information technologies.
  3. Analyze the ethical and legal aspects of the IT field: Students will understand the ethical issues related to the use of information technology and will have the ability to analyze the legal aspects arising in this field. They will be aware of the importance of ethical principles, confidentiality and protection of personal data.
  4. Distinguish the relationship of IT law with other branches of law: Students will understand the relationship of IT law with other branches of law such as civil law, criminal law and administrative law. They will understand how IT law affects the legal status of individuals and regulates the use of technology in various areas of life.
  5. To navigate the current trends and development of IT law: Students will be introduced to the current trends and development of IT law, including new legislative acts, judicial practice and international standards. They will be able to track changes in IT law and assess their impact on IT practice and business.

These learning outcomes will allow students to be competent in the field of IT law, to use their knowledge and skills to analyze and solve legal problems related to information technologies.
